“Free Speech, Hate Speech and Campus Speech”
Freedom of thought and speech are central to the mission of colleges and universities. However, campuses also serve as a home away from home for students from diverse backgrounds, who can find themselves the object of hate speech that interferes with their education. Can universities reconcile their commitment to wide-open free expression and with their commitment to the creation of a welcoming inclusive community? Professor Dorf will discuss the governing legal principles under the First Amendment. However, private universities like Harvard and Cornell are not legally bound by the First Amendment. To what extent, if any, should private universities depart from First Amendment principles and adopt hate-speech regulations of the sort one finds in Canada, Europe, and other parts of the world?
